Kijiji Buyers BEWARE of Puppy SCAM!

Gail Benoit & Dana Bailey continue to sell puppies despite their previous convictions of Animal Cruelty and upcomming charges on numerous other animal cruelty charges. They are now operating out of Dartmouth/Halifax area & continue to post ads on Kijiji in hopes of generating new sales.

"There was no doubt the pair mistreated dogs."

"The distressed state of the puppies was not a sudden occurrence. It developed over time. Even if the appellants’ control of the puppies had been brief — a matter of days — there was ample time and opportunity to relieve their then obvious distress, or to begin doing so,"

RICK'S RANTS

Puppy brokers guilty!
Halifax News Net

" Guilty was the verdict in Digby provincial court yesterday, a decision roundly applauded by those involved in animal rescue. Gail Benoit and Dana Bailey have been on their hit list for years. The pair run Puppies 'R Us out of their Digby County home and have been the subject of many complaints over the years after dogs they sold got ill and even died. Often they would do their business from the back of a van in mall parking lots. The husband and wife team were tried on charges of animal cruelty after 10 puppies were seized from their home in the fall of '07. During the incident, Benoit threw a pup at an SPCA officer. The couple will be sentenced the end of March. The SPCA wants the two banned from ever owning or selling animals again. The courts do have the authority to impose such a ban. Let's hope the good judge throws the book at these two.

The provincial government also has to bring in tougher measures to deal with puppy mills which operate freely in Nova Scotia. That's right, there's no law declaring these operations to be illegal and no requirement for any special licensing to sell animals. Until the government cracks down, these fly by night operations will continue to thrive."

Thank you to another voice!

Gail Benoit and Dana Bailey are convicted on all counts on animal cruelty charges stemming from puppies removed from their property by the NS SPCA in October, 2007 - and an assault charge against Gail Benoit

Digby County woman tells judge 'decision is ludicrous'

Puppy sellers convicted of animal cruelty

DIGBY — A Digby County puppy seller convicted of animal cruelty and assault Thursday launched into a tirade against the judge who handed down the decision.

"I find you guilty," Judge Jean-Louis Batiot said to Gail Benoit, 39, as she stood beside her husband, Dana Bailey.

Mr. Bailey, 46, was also convicted of animal cruelty in Digby provincial court Thursday.

"I think that your decision is . . . ludicrous," Ms. Benoit shot back at the judge before denouncing her treatment.

Judge Batiot told her to take it up with her lawyer, raising his voice to be heard.

The lawyer for the couple, Michael Power of Bridgewater, was unable to attend court because of poor weather.

Ms. Benoit and Mr. Bailey were tried last year on charges of animal cruelty stemming from the seizure of 10 puppies from their Roxville home in October 2007.

Ms. Benoit was also charged with assaulting SPCA investigator Nancy Noel while the dogs were being taken during the execution of a search warrant. Ms. Benoit was convicted on that charge Thursday.

Outside court, Ms. Noel, an SPCA special constable, said she was at the couple’s home in 2007 when Ms. Benoit suddenly chucked a puppy at her.

"She threw the puppy at me, then she stepped on my foot and shoulder-checked me," Ms. Noel said.

The couple operates a business, Puppies R’ Us, that is listed on a government website as a partnership involved in the retail sale and delivery of puppies.

The address of the couple’s blue bungalow is the same address given for the puppy company.

Some people have complained to the SPCA about puppies they have purchased from Ms. Benoit. Some of the young dogs died soon after.

Judge Batiot did not read his written decision publicly Thursday but made sure the couple received a copy.

They are expected to be sentenced March 26.

As Judge Batiot announced his decision, Ms. Benoit seemed to have a hard time accepting her fate.

"This is going to be all over the Internet," she said, interrupting the judge.

Ms. Benoit also brought a couple of letter-sized sheets of paper and waved them toward the judge.

"This has got to stop," she said, reading "wanted . . . dead or alive" from one of the pieces of paper that appeared to be a mock wanted poster of Ms. Benoit.

When the judge told her to talk to her lawyer about it, she turned on her heel and left with her husband.

"Pay no mind to ’em. . . . Keep going. Keep going," Mr. Bailey said as his wife continued to spout off.

"Everybody beware. The SPCA are corrupt," she warned courtroom observers.

"Yeah, they’re crooks," added Mr. Bailey.

Mr. Bailey also indicated he was not interested in returning to court.

"There will be no sentence date," he said loud enough to be heard in the public gallery as they left in a huff.

Roger Joyce, another SPCA investigator in court Thursday, said his organization will push to ban the couple from owning or keeping animals.

N.S. couple found guilty in notorious animal cruelty case

By BRIAN MEDEL Yarmouth Bureau

DIGBY — A Nova Scotia judge convicted Gail Benoit and Dana Bailey of animal cruelty today after a trial last November in Digby provincial court.

Judge Jean-Louis Batiot also convicted Ms. Benoit of assaulting an SPCA constable.

The couple had been tried on charges of animal cruelty stemming from the seizure of 10 pups from their home near Digby in October of 2007.

They have been accused of selling sick puppies.

Ms. Benoit seemed to have a hard time accepting her fate today when Judge Batiot announced his decision.

“This is going to be all over the Internet,” she said, interrupting the judge.

Ms. Benoit also brought a couple of letter-sized sheets of paper and waved them toward the judge.

“This has got to stop,” she said, reading, “Wanted ... dead or alive,” from one of the pieces of paper which appeared to be a mock "Wanted" poster with Ms. Benoit as the fugitive.

When the judge told her to talk to her lawyer about it, she turned on her heel and left with her husband.

The couple's lawyer, Michael Power of Bridgewater, was unable to attend court because of poor weather.

The couple will return to court on March 26 for sentencing

Benoit, Bailey guilty of animal cruelty, assault

Digby County puppy brokers to be sentenced Mar. 26

Digby County puppy brokers Gail Benoit and Dana Bailey were found guilty, today, Jan. 29, on two counts of animal cruelty stemming from the October 2007 seizure of 10 puppies from their Roxville property.

Gail Benoit was also found guilty of assaulting SPCA special constable Nancy Noel at the time of the seizure.

Dangerous road conditions prevented Benoit and Bailey’s lawyer, Mike Powers, from attending court and Judge Jean Louis Batiot advised that sentencing will take place March 26.

The 2007 seizure of 10 sick and malnourished puppies by Nova Scotia SPCA chief investigator Roger Joyce and special constable Nancy Noel followed complaints filed with the SPCA.

Both Noel and Joyce were present for Judge Batiot’s verdict and say they hope Benoit and Bailey will be prohibited from owning animals. Such an injunction could conceivably come prior to the March 26 sentencing date.

Joyce says he makes frequent checks on people who are prohibited from owning animals.

In addition to the charges from the 2007 seizure, Benoit and Bailey face animal cruelty charges filed three weeks ago—relating to their 2008 sale of puppies infected with the deadly parvovirus.

Gail Benoit addressed Judge Batiot after he read the verdict. “This has got to stop,” she said. “My family is terrified and people have threatened to burn my house down.”

“The SPCA is corrupt,” she said, as she left the courtroom.

well as i have said many times the chapmans should not have sold puppies that wearnt weaned,
but as much as gail would have you believe her and dana arent guilty for those dying pups----i beg to differ as they knew those puppies were all dying, as 12 died on them, and they just took them out and supposedly buried them in there back yard . supposedly without wondering why they died ----which leads me to believe they knew why they died, and there for they had to rush out, and sell of the ones still barley alive, to get the money for them. before they died to AND they would also have to bury them or put them in the garbage ---but that would also mean no MONEY in there pockets ----so look here we come, to suck you people into buying these dying pups, so we get our MONEY -- and we dont care how many die, or how many men, women or children we hurt---JUST GIVES US YOUR HARD EARNED MONEY AND WE WILL GIVE YOU A LIFE TIME, OF REGRETS,PAIN AND SUFFERING ---ALONG WITH LARGE VET BILLS.

Great Post at Dogkisser about Benoit & Bailey.
Things are ramping up for next week - on January 29th Gail Benoit and Dana Bailey are due back in court to hear whether or not they're going to be found guilty or innocent on their current charges of animal cruelty stemming from puppies that were seized from their house a couple years ago. This doesn't include the 4 cruelty charges they were just recently charged with regarding the puppies this past summer that they sold to Esther Smith and one other lady - the Chapman kennel puppies.

[1] Bailey and Benoit, who were jointly charged in an Information, bring this appeal from both conviction and sentence. They were convicted, after trial, of two offences alleging that

“At or near Marshalltown, in the County of Digby, Province of Nova Scotia did willfully cause unnecessary suffering to a dog by neglecting to provide adequate food and water, contrary to Section 11(1) of the Animal Cruelty Prevention Act.”

and

“At or near Marshalltown, in the County of Digby, Province of Nova Scotia, did willfully cause unnecessary suffering to a dog by neglecting to provide it basic medical attention and adequate food and water, contrary to section 11(1) of the Animal Cruelty Prevention Act.”

The major focus of the trial as reflected in the evidence was the condition of a female dog which had recently birthed and suckled thirteen pups. She was described by the veterinarian, Dr. Pothier, whose evidence Judge Prince clearly accepted, as “emaciated”. It was the sight of this dog in her immediate circumstances on a cold day in November that prompted Rebecca Longmire to report this animal “in a neglected state”. Indeed, among the opening words of the Crown Prosecutor in his final submissions, were “it’s clear...that the animals in this case...were not properly cared [sic] and not maintained.”

I feel another batch of puppies being posted in the near future!!!!!!!! Being in a pet business i will get the odd call from someone looking for a puppy. So i will ask what kind (as i may be able to refer them to a responsable breeder) they will answer back any kind, again hmmmm!!!! DO SOME RESEARCH not any is suited for any people... Figure out what kind of dog will fit well with you, in doing this you will end up with a very special friend, and NOT another pup / dog looking for a new home because he got to big or stayed to small. There are many good breeders who have been breeding healthy dogs for many years and know what they are talking about and will even tell you if they feel that maybe their breed is not the type of dog that will fit into your life giving you time to rethink and saving another unwanted dog being posted......BECAUSE REALLY DOGS CAN'T TALK!!!!!!!! letter from a shelter manager

A Letter from a Shelter Manager

I think our society needs a huge "Wake-up" call. As a shelter manager, I am going to share a little insight with you all...a view from the inside if you will.
First off, all of you breeders/sellers should be made to work in the "back" of an animal shelter for just one day. Maybe if you saw the life drain from a few sad, lost, confused eyes, you would change your mind about breeding and selling to people you don't even know.

That puppy you just sold will most likely end up in my shelter when it's not a cute little puppy anymore. So how would you feel if you knew that there's about a 90% chance that dog will never walk out of the shelter it is going to be dumped at? Purebred or not! About 50% of all of the dogs that are "owner surrenders" or "strays", that come into my shelter are purebred dogs.

The most common excuses I hear are; "We are moving and we can't take our dog (or cat)." Really? Where are you moving too that doesn't allow pets? Or they say "The dog got bigger than we thought it would". How big did you think a German Shepherd would get? "We don't have time for her". Really? I work a 10-12 hour day and still have time for my 6 dogs! "She's tearing up our yard". How about making her a part of your family? They always tell me "We just don't want to have to stress about finding a place for her we know she'll get adopted, she's a good dog".

Odds are your pet won't get adopted & how stressful do you think being in a shelter is? Well, let me tell you, your pet has 72 hours to find a new family from the moment you drop it off. Sometimes a little longer if the shelter isn't full and your dog manages to stay completely healthy. If it sniffles, it dies. Your pet will be confined to a small run/kennel in a room with about 25 other barking or crying animals. It will have to relieve itself where it eats and sleeps. It will be depressed and it will cry constantly for the family that abandoned it. If your pet is lucky, I will have enough volunteers in that day to take him/her for a walk. If I don't, your pet won't get any attention besides having a bowl of food slid under the kennel door and the waste sprayed out of its pen with a high-powered hose. If your dog is big, black or any of the "Bully" breeds (pit bull, rottie, mastiff, etc) it was pretty much dead when you walked it through the front door.
Those dogs just don't get adopted. It doesn't matter how 'sweet' or 'well behaved' they are.

If your dog doesn't get adopted within its 72 hours and the shelter is full, it will be destroyed. If the shelter isn't full and your dog is good enough, and of a desirable enough breed it may get a stay of execution, but not for long . Most dogs get very kennel protective after about a week and are destroyed for showing aggression. Even the sweetest dogs will turn in this environment. If your pet makes it over all of those hurdles chances are it will get kennel cough or an upper respiratory infection and will be destroyed because shelters just don't have the funds to pay for even a $100 treatment.

Here's a little euthanasia 101 for those of you that have never witnessed a perfectly healthy, scared animal being "put-down".

First, your pet will be taken from its kennel on a leash. They always look like they think they are going for a walk happy, wagging their tails. Until they get to "The Room", every one of them freaks out and puts on the brakes when we get to the door. It must smell like death or they can feel the sad souls that are left in there, it's strange, but it happens with every one of them. Your dog or cat will be restrained, held down by 1 or 2 vet techs depending on the size and how freaked out they are. Then a euthanasia tech or a vet will start the process. They will find a vein in the front leg and inject a lethal dose of the "pink stuff". Hopefully your pet doesn't panic from being restrained and jerk. I've seen the needles tear out of a leg and been covered with the resulting blood and been deafened by the yelps and screams. They all don't just "go to sleep", sometimes they spasm for a while, gasp for air and defecate on themselves.

When it all ends, your pets corpse will be stacked like firewood in a large freezer in the back with all of the other animals that were killed waiting to be picked up like garbage. What happens next? Cremated? Taken to the dump? Rendered into pet food? You'll never know and it probably won't even cross your mind. It was just an animal and you can always buy another one, right?

I hope that those of you that have read this are bawling your eyes out and can't get the pictures out of your head I deal with everyday on the way home from work.

I hate my job, I hate that it exists & I hate that it will always be there unless you people make some changes and realize that the lives you are affecting go much farther than the pets you dump at a shelter.

Between 9 and 11 MILLION animals die every year in shelters and only you can stop it. I do my best to save every life I can but rescues are always full, and there are more animals coming in everyday than there are homes.

My point to all of this DON'T BREED OR BUY WHILE SHELTER PETS DIE!

Hate me if you want to. The truth hurts and reality is what it is. I just hope I maybe changed one persons mind about breeding their dog, taking their loving pet to a shelter, or buying a dog. I hope that someone will walk into my shelter and say "I saw this and it made me want to adopt".

THAT WOULD MAKE IT WORTH IT

Woman buys Internet names of puppy mill suspects
By JEFFREY SIMPSON Staff Reporter
Tue. Jan 20 - 7:10 AM

A Halifax woman has seized the Internet domain names of a Digby County couple facing animal cruelty charges to prevent people from buying their puppies.

Joan Sinden, who lives in Spryfield, last week bought http://gailbenoit.ca and http://danabailey.ca, which link to a site on her server with information about the activities of the husband-and-wife team with a controversial history of selling allegedly unhealthy dogs.

"I just want to educate people," Ms. Sinden, a self-described animal activist dedicated to stopping puppy mills and brokers, said in an interview Monday. "I thought someone should do it and I already had most of the information together already."

The Nova Scotia SPCA this month laid eight charges against Dana Bailey, 46, and his wife, Gail Ruth Benoit, 39, of Roxville for allegedly selling four dogs that died hours after their new owners received them last summer.

Mr. Bailey and Ms. Benoit each face four animal cruelty charges under the Criminal Code of Canada and four under the provincial Animal Cruelty Prevention Act. Autopsies showed the dogs died of parvovirus, a highly contagious canine illness often fatal in young dogs.

The couple are due in Digby provincial court on Jan. 29 on other charges stemming from the SPCA seizing several seriously ill puppies that were for sale.

Ms. Sinden said she hasn’t had any personal contact with Ms. Benoit and Mr. Bailey and doesn’t know anyone who has bought animals from them; she just wants to persuade the couple to earn a living another way.

"I have owned dogs that came from puppy mills and I have seen the effects of it," Ms. Sinden said. "I see the fact that their teeth are rotten and they have no hair and that they’ve had a really shitty life and I don’t think it’s right for animals to have to live like that.

"While they’re alive, they should have a certain quality of life, just like humans have a certain quality of life. I don’t think that animals are any different than us."

Her website links to information about parvovirus and news clips of the couple on YouTube, including a hip hop-style montage.

Mr. Bailey said he isn’t responsible for the deaths of any dogs and doesn’t plan to check out Ms. Sinden’s website.

"There are so many websites out there now, another one ain’t gonna hurt one bit," he said. "I’m not one bit concerned."

Mr. Bailey said he and Ms. Benoit, who declined to comment for this story, are still selling dogs and have no plans to stop.

"We’ve got proof of what the dogs died from but we’re not bringing it out until after the SPCA goes through with some more so-called charges — and then we’re going to show what the dogs died from," Mr. Bailey said.

"I have video of what the dogs died from."

David Tidswell, 21, of Halifax, said he recently found an ad of Ms. Benoit’s on the classified website kijiji.ca offering a purebred chihuahua for $300. He said he was selling his computer at the same time and struck a deal to make a trade.

They met at an Esso gas station parking lot in Bridgetown on Jan. 3 at about 10 p.m. After getting the dog home, Mr. Tidswell said, he did some research on the Internet and learned about Ms. Benoit’s alleged selling practices. A few days later, the dog became ill and died, he said.

Halifax man says accused puppy mill owner traded him a sick chihuahua

By AMY SMITH Provincial Reporter
Wed. Jan 14 - 5:39 AM

David Tidswell says he didn’t see the warning signs when he arranged to pick up his new chihuahua at a Valley gas station earlier this month.

Ten days later, the dog, which he named Keelie, was dead.

Now the Halifax man wants to warn people about the woman he says traded him the dog for a desktop computer.

Mr. Tidswell, 21, said it was after he brought the dog home that he learned the woman he got the animal from is facing four animal cruelty charges under the Criminal Code of Canada and four under the provincial Animal Cruelty Prevention Act.

The Nova Scotia SPCA laid charges last week against Gail Ruth Benoit, 39, and her husband Dana Bailey, 46, of Roxville, Digby County, who sold four dogs that died hours after their new owners received them last summer.

The couple is due in Digby provincial court on Jan. 29 on other charges stemming from an SPCA seizure of several seriously ill puppies that were for sale.

Mr. Tidswell said he found an ad on the classified website kijiji.ca, offering a purebred chihuahua for $300. He said he was selling his computer at the same time and asked the dog seller if she was willing to make a trade.

When she agreed, he said they arranged to meet at an Esso gas station parking lot in Bridgetown on Jan. 3 at about 10 p.m.

Mr. Tidswell said in an interview Tuesday evening that he should have been more wary.

"The signs weren’t clicking in," he said. "I was in excitement mode. I was getting a dog."

Once he got the dog home, Mr. Tidswell said he did some research on the Internet. It was then, he said, that he realized he had bought the dog from Ms. Benoit.

He said he called and asked her if the dog was healthy.

"She said the dog was fine," he said. "It was probably nervous and whatnot. And the dog had just had a litter of puppies, apparently."

But two or three days later, Mr. Tidswell said, Keelie started getting sick. He said the dog became lethargic, her eyes were bloodshot and had mucus in them, and her breathing was rough. Soon, the dog was vomiting and had diarrhea and dark urine, he said.

Mr. Tidswell, who said he works from home but did not want to say what he does for a living, said he didn’t take the dog to the vet because he was waiting for his paycheque to come in.

He said that on Monday night, he gave her a bath, wrapped her in a blanket and set her on the couch. When he returned, Mr. Tidswell said, the dog was dead.

Mr. Tidswell said he called the SPCA to lay a complaint against Ms. Benoit but was told the agency couldn’t do anything because he had already disposed of the dog’s body. He said he also called Ms. Benoit on Tuesday morning.

When reached by phone Tuesday evening, Mr. Bailey refused to comment on the allegations. However, he told CTV News there was nothing wrong with the dog.

"The dog was eating good here. The dog just had pups," Mr. Bailey said.

"I told him to send more confirmation of the dog dying and he can have his computer back," Mr. Bailey said.

Watch CTV news @ 11pm Gail is on the news again!

Local News for January 13th, 2009

Another person has bought a dog from Dana Bailey and Gail Benoit, and 10 days later the dog died. David Tidwell picked up the chiuaua he traded for a computer. The 1 and a half year old dog was apparently given to them by someone in Kentville and has bore at least one puppy in the three months since. Not long after buying the dog, Tidwell says things went sour as the dog had no energy, red eyes, started passing blood and passed away last night. Bailey and Benoit have been contacted by the buyer and the SPCA and they dismiss the claims. SPCA officials say the dog was disposed of so an autopsy can't be done, but the symptoms are consistent with parvo virus, the illness previous autopsies revealed to be the cause of death of several puppies sold by the Puppies R' Us company. Bailey and Benoit are currently charged with two separate counts of animal cruelty each. The SPCA is looking for a new companion for Tidwell, so if you would like to donate a healthy chiuaua or other breed, e-mail winniepooh345@hotmail.com.

This dog is said to be the mother chihuahua of the pups being sold on kijiji.ca. She was also reported to be urinating blood & showing signs of the deadly parvovirus.

"Prevention is the only way to ensure that a puppy or dog remains healthy since the disease is extremely virulent and contagious. The virus is extremely hardy and has been found to survive in feces and other organic material such as soil for over a year. It survives extremely cold and hot temperatures. The only household disinfectant that kills the virus is bleach.[19]

Weaning puppies can be vaccinated with a modified live virus low passage high titer vaccine at 6 weeks of age, then every 3 to 4 weeks until 15 or 16 weeks. - wikipedia.org

Vets in the Maritimes are very aware of Gail & Dana, most are unwilling to do business with the pair. So chances are thier pups & dogs have NEVER seen a vet or had any vaccinations are extreamly high!

Banish Puppy Ads

The Chronicle Herald
Reader's Corner

We need the public to stop buying sick puppies from classified ads. We have all individually written Kijiji, eBay and/or Wells Fargo, which are all connected. We have asked them to stop selling live puppies on Kijiji (eBay does not sell live animals). None of us has received a response from any of them, which is why we are writing this letter.

Other classified outlets have banned the people who are up on charges for selling these poor, sick, dying pups.

If you are asked to meet in a parking lot, or to have your puppy delivered, this is a red flag. Most breeders are responsible about how they conduct their business and will welcome you into their home, let you view one or both parents, and provide proof-of-health checks and vaccination records that are not photocopied.

It is OK to ask for references, especially veterinary references – this is the responsible thing to do! Go to Google and research the breeder/broker prior to purchase. Check with the Better Business Bureau.

Please be careful and thorough. The only way these people will be put out of business is if we, the public, stop buying from them. Please, please, please stop buying these puppies.

Facebook Group Successful in Lobbying

Facebook Group Successful in Lobbying Online Classifieds Company to halt sale of dogs

An online classified website has halted the sale of dogs on their entire website currently serving 7 major cities in Canada. Unlike Kijiji.ca, golistings.com remained open minded during the negotiations with the Facebook group. Owner / operator of golistings.com, Tom Piasecki said “I like the idea… it does seem logical, I too would not want to see animal cruelty” and also asked the group if they had “Any other thoughts or ideas for improvement.” Mr. Piasecki, who resides in Ontario, felt the group had a valid cause for concern, and removed the “Dogs For sale” category from the classified site immediately after negotiations ended.

Over the past year a lot of concerns have been raised over the Kijiji.ca website by Maritimers. First by an animal rescue coalition after Kijiji.ca started aiding people to buy and sell dogs / puppies. Kijiji which is owned by Ebay has failed to address anyone’s concerns regarding the sale of dogs in months. Ebay, the owner of Kijiji who operates online auctions does not allow the sale of any live animals and hasn’t for years – though on Kijiji they allow the sale of live animals of any species.

After the sale of very sick, dying puppies to many Maritime families last summer and fall, a Facebook group was created by Esther Smith of Tatamagouche, Nova Scotia. Esther had paid $500.00 for a miniature dachshund from Gail Benoit and Dana Bailey in July 2008 that died 10 hours after the transaction from a Digby area couple. Ms. Smith purchased this dog on Kijiji.ca, as well as the many other families who became victims to the Benoit / Bailey puppy broker operation. Ms. Smith says “my main objective is to educate the public in the safest and most humane way to purchase or adopt a dog.” Ms. Smith also said “People are still going on websites like Kijiji.ca and buying puppies from puppy mills and brokerage operations.” “A lot of good, responsible breeders can be found on the online classified site, but there are still a few puppy mill operations and brokerage services that remain in business because of the ability to make quick, fast cash sales – sometimes in parking lots,” smith said. Smith purchased her puppy in the McDonald’s parking lot in Windsor, NS and stated “If someone wants to delivery the puppy and insists on it – something is wrong. Responsible breeders should welcome you into their home and provide veterinarian references – I just wished I had done that myself.”

Ms. Smith and some of her group members have lobbied the Ebay owned company Kijiji for a very long time now. “It has been 7 months now, and we have still not received a reply.” In fact Ms. Smith took it upon herself to place warnings in Kijiji hoping to prevent any further sales of sick or dying puppies. Ms. Smith whom continued to post warnings on a weekly basis, found herself banned from the website in late October. “ I don’t know why they banned me, I am trying to save people from going through the same hurt and pain I feel everyday after finding my cinni girl dead” said smith.

Ms. Smith and her group are more than thrilled to have classified businesses on their side. “It isn’t just golistings.com who has assisted us, but others like the Bargain Hunter who have fully cooperated as well and now monitor their pet categories more carefully.” “If only Kijiji would listen, respond, reason or agree – I know I could prevent puppy mills and brokers from reaching out to potential buyers who may aid puppy mills and brokers with cash sales, which keep them in business.”

The Facebook group will continue to lobby Kijiji.ca to change their pet classifieds, however many group members feel they are on the road to nowhere. They are very thankful for the cooperation of many Maritime classified businesses, and are also very pleased with the new animal cruelty charges laid against Gail Benoit and Dana Bailey of the Digby area.

Benoit, Bailey charged again !!!

Roxville puppy brokers face new animal cruelty charges

Three weeks before receiving the verdict on their 2007 animal cruelty charges, puppy brokers Gail Benoit and Dana Bailey are facing new charges of animal cruelty.

The Digby County puppy brokers were served today, Jan. 5, with charges relating to their sale in August 2008 of puppies that died from the fatal parvo virus within hours or days of being purchased by their new owner.

Although the SPCA received calls from additional individuals who had purchased gravely ill puppies from Gail Benoit, the current charges relate to four puppies that had autopsies performed on behalf of the Nova Scotia SPCA.

Sean Kelly said the SPCA’s investigations unit has been building the case over the past several months and CTV news footage, in which Bailey talks about puppies dying on their property while in their care, was seized as evidence.

Kelly said the SPCA continue to investigate additional reports of sick puppies sold by Benoit and Bailey.

Charges Laid Today in Digby Puppy Broker Case

FOR IMMEDIATE RELEASE

New Charges Laid Today in Digby Puppy Broker Case

New charges of animal cruelty were laid today against Gail Benoit and Dana Bailey, puppy brokers operating out of the Digby area. Benoit and Bailey garnered attention in August when the owners of sick puppies purchased from the couple came forward with their stories. Four of those puppies died from the fatal parvo virus within hours or days of being purchased by their new owners.

“Today’s charges are a result of months of work by our investigations unit, gathering the information required to attain warrants and press charges, including the execution of a warrant to seize footage from CTV News. While we are pleased to announce that these new charges have been laid, we urge the public to remain vigilant about puppy brokers and make educated decisions about purchasing any pet,” says Sean Kelly, Chair of the Nova Scotia SPCA Investigations Committee. “The real power to stop puppy brokers and shut down puppy mills lies is consumer power: if people stop supporting these businesses by buying puppies from them, they will not be able to operate,” Kelly continues.

The Nova Scotia SPCA encourages adoption as a humane alternative to purchasing pets. SPCAs in Nova Scotia are often overflowing with young and adult animals that deserve loving new homes. Often, adoption fees include vaccinations, microchipping, and the pet's spay or neuter operation, making adoption not only a humane option, but an affordable one as well. For those interested in a specific breed of dog or cat, there are many breed-specific rescues that can help match adopters to lifetime companions.

The Nova Scotia SPCA also supports acquiring pets from reputable breeders who take responsibility for their animals for their entire lives, educate and screen potential new owners, and provide follow-up support after purchase or adoption.

The Nova Scotia SPCA is a non-profit registered charity organized under the provincial Animal Cruelty Prevention Act, dedicated to the prevention of cruelty to animals and to the promotion of respect and humane care for animals. The Nova Scotia SPCA relies almost entirely on donations to sustain its animal cruelty investigations unit.

For media interviews or further information, please contact Sean Kelly or Mary Hill at media@spcans.ca or call the Nova Scotia SPCA provincial office at (902) 835-4798.

Dear Judge Jean-Louis Batiot

Re: Benoit / Bailey Case

I am writing on behalf of myself and the many animals’ lives that have been affected by the dealings of “Puppies R Us” over the past dozen or so years.

I tend to stay calm, cool and collective while hearing about the numerous cases of animal abuse which take place every year in this province, and pray that the law does their part to insure it does not take place again.

I’ve been following the case of Puppies R Us, and I believe deep down inside that something has to end the suffering. I know this is not their first time with “ problems “, but I sure hope that it is the last.

What scares me the most is Dana Bailey casually mentioned during his trial that they are unable to locate a vet in Nova Scotia to deal with them. I personally needed to verify this, so I called every vet clinic in Nova Scotia and asked them if they were aware of them and if they would refuse them business, this I found to be true. I then thought what if they had a dog which was very ill and were unable to access any medical attention; wouldn’t this be like a mother with a sick child and no doctor? It would not be fair for the animals!

They have done so much “self damage” to themselves that nobody wants anything to do with them. I feel that they have earned these problems, and being unable to provide medical attention if required to any animal they should not be allowed to own them, and sure as hell not able to sell them.

I found myself emailing, phoning and writing families which have lost their puppies purchased from Benoit and Bailey. It was a very emotional time by everyone; I even spoke to grown men who still hurt from what took place. People’s hard earned money is being burnt up by Puppies R Us, and everyone knows it! But only I and the families whom purchased puppies from Benoit and Bailey really know how deep the scars do go. There are more than 30 maritime families which have lost puppies shortly after purchasing just in the last year! Please don’t let this continue. I have wrote Air Canada, Bay Ferries Ltd and other forms of transport and they have now agreed to NOT aid her with her business, not because of me – but because of investigations done of previous problems they have had with her.

I trust and know that you will make the best decision possibly for this case, and I hope to be able to sleep at night once again knowing that they are unable to traffic, hoard, or own anymore animals ever again.

Warmest Regards,

A Concerned Animal Lover

What did I ever do

What did I ever do to be born into the hands of someone so cruel. I was so cute and cuddly, You took me away from my mother at a young age. I cried, you did not care. You posted ads about me even though I was feeling ill, you never cared. You told people that you took me to the vet you lied. I went to someone that called me Mama, I was too sick and I died in the very arms of the only person that loved me. What did I ever do. As I closed my eyes I thanked the lady that bought me although she had no money left ,she made sure I went to the vet. It was to late but yet she still held me as I took my last breath. at least I knew I was loved if even for such a short time. Please do not let me have died in vain. This lady needs to be punished. rules and regulations set. I need justice for me and the others that can not speak for themselves. The madness needs to stop. puppies are not flea market items to be sold in parking lots like they have no souls or no meaning. People need to wise up and only buy from reputable breeders or a shelter. I am in shock people will complain about a 125.00 adoption fee from a shelter that you know your puppy has all its shots and has been neutered but yet they will pay 600.00 in a mall parking lot and not truly know what they are getting. It is like Russian roulette will this puppy live or die. I know that the lady that is behind all this controversy knows who she is, she will never stop because she has no heart. Please I am begging the courts to wise up and please put these idiots in jail and throw away the key.

I am just absoultely amazed that Gail Beniot is still profiting from the sale of sick and dying puppies.
I is just appaling that our justice system is such that this is allowed to continue.
Maybe everyone should write and call their local and provincial politicans with a formal complaint. There has to be some way for this to stop.....but it doesn't stop with just Gail Beniot....someone is selling her the poor little sick puppies....they have to be stopped too.

Hey lady, im going to try to be as nice as I can....but you did one thing wrong... and that was to mess with my children. Because of that i'm going to make sure you are held responsible for your actions.

You met ME in a WALMART parking lot, which was stupid on my side, because I saw many warning about a person like you.

You fooled me into trusting you, then fooled me into giving you the money.

Let it be known here and now that I will make sure that you are held 100% responsible for this.

If Esther Smith is watching please resend me your phone number because I had problems with my email and it got deleted.

If anyone knows the exact address to the woman who sold me this puppy please give it to me as I have friends who want to pay her a visit

To answer your questons Gail ...

1- what the hell is everone trying to do?????

People want your abuse & sales of sick animals to stop!!! This has been an ongoing issue for years now, it did not start with a "set up" or a batch of so called sick puppies from NB as you claim.

THe lawsuit you had against Chapmans Kennels had been dismissed by the judge due to lack of evidence on YOUR part. --> therefore you could not prove that the puppies where sick when u got them. See Dogkisser Chapman Kennels vs Gail Benoit & Dana Bailey.

** even though u where warned by Chapmans they where only 4 weeks old, in which you told them you would give them extra $$$ for the too young stock........ which later died. Some buried in your own back yard *** as you admitted to the the CTV news yourself, the rest died in unknowning buyers arms!! Which have yet too see a refund!!!

Just look at the harrassement seen here: (a) & (b) you have done to Esther Smith since she's gone out on the news & filling a BBB complaint.

This was all AFTER the SPCA seized 10 neglected puppies Oct. 26/07;

This is what you are on trial for!!!

Aniaml Abuse.com has records from both you and your commonlaw from back in 2000.
"Nov 23, 2000 Alleged: 3 starving, hypothermic dogs seized from yard"

As far as this so called law suit with the SPCA for 1/2 million; the evidence alone in the media is enough to convict you. In my opinion, the SPCA owes you nothing... you should be ashamed of yourself!!!!

"Autopsies: Parvovirus killed pups Digby woman insists they were healthy when she sold them By MARY ELLEN MacINTYRE Truro Bureau

Gail Benoit sold four puppies last month that died not long after the new owners taking possession of them. (BRIAN MEDEL / Yarmouth Bureau / File)

Autopsies on four puppies who died shortly after being sold by a Digby puppy broker last month show three died of parvovirus. The cause of the fourth puppy’s death was undetermined."

Which answers your last question ....

2- what is going on here is anyone paying attention here or what???

That is exactually what the problem is, there are now 100's of animal lovers paying atttention to YOUR situation. All u have to do Gail is stop selling sick puppies!!!!

Your latest victim's post on kijiji was removed -- why was that ?

Where you afraid "a few of the 100's animal lovers paying atttention" - one of them might see it, and know that this terri poo was the one you tired to sell to Susan earlier in December for 600 $ in Save Easy parking lot??? He/She was eventually sold to some unexpecting buyer Dec 30th & DIED the next day !!

Gail : You lie & scamm so much that 1/2 the time you can not even remember the facts yourself.... So i have included lots of links in this little Q & A for you to refresh.

We ask and plea to you:

Find another product to sell!!
END THE MADNESS!

Once Upon A Puppy

A Personal Experience with Gail Benoit & Dana Bailey.

Walmart dead terripoo puppy plea to seller on Kijiji

Wanted kijiji Ad

Wanted: People to buy puppies and use common sense. Know where your dog comes from. If the sellers want and insist on delivering the dog...RED FLAG! Learn about Parvo virus and how it is spread so easily from infected premises and handlers. Read the certificate that comes with the dog. No certificate? Give it a miss then. If there is a paper, make sure it is not a photo copy that has been altered to seem to fit your dog.(common practice from dishonest sellers)Reputable breeders and sellers offer a guarantee. (If it is 24hrs,then the dog most likely has Parvo). Is the seller selling out of her car? Run away!!! Remember parvo can get on your shoes, car tires etc.Did the seller insist on you giving your phone number but she refused to give you hers? Why was that? Do you read all the warnings on here about Benoit/Bailey? Pay attention because it will spare you in the long run. I cannot believe that people so easily part with 800.00 for a puppy that has no papers, or proof that it is healthy. They take the word of someone who looks like Cruella Deville, that the dog is the breed that you want. (It is likely a lie)Does the person on the phone sound like a crack smoking witch? Hang up! Rescue a puppy from shelter near you!!! Safer, wiser, smarter, cheaper

Thanks again Esther

From kijiji.ca
Thanks goes to Esther Smith for saving a lot of people from the same heartbreak that she had this summer when her dear little mini dachshund died of parvo and was sold as a 9 week old when it was in fact only 4 weeks and not weaned. She has continually warned us through the press, and facebook groups and Kijiji. We need to educate the public every way available so that NOBODY ever buys a dog from a parking lot, flea market, etc. You need to be wise when spending money on a dog. Go to the nearest animal shelter and be a HERO and rescue a nice , healthy dog. They have little dogs too. If you answer an ad because the seller has a pic of a cute little, teddy bear, be very careful that it is not from a well known puppy miller/broker who sold Esther her pup. Let us all hope they are found guilty of cruelty and are banned from owning so much as a flea.(they have plenty to spare). Thanks again Esther, people are finally catching on.....I hope

(kilburn Nb)

i dont know why everyone is so against this place. for my experience, my
bf and i bought a mini american eskimo from there in July 08 and she is the most
heathly little puppy there is.. she is a beautiful, hyper little girl.so maybe
before judging you should go and take a visit there.

I purchesd my dog there and they brought me around this past summer when
i responded to an add on kijij and they walked us threw all of the kennels of
puppys and i never seena single sick or dyeing or dead puppy they were all
healthy and good taken care of pupps i don't know where you folks are getting
your info buts its slander cause when i got my pup it was fine they were even
concenred to make sure i watched the dog and not to let it eat random stuff
outside also they wanted me to make sure she got her needles on time, these
people were very carring towards the dogs and asked us a handfull of quetions
before we even took the puppy home. then they even asked us to email them a
couple months later and show them pics of the puppy to make sure she was being
taken good care of which we glady did so please stop slandering these people
yeah not every puppy is fully healthy some do get sick but to sit there and say
you bought 27 puppys and omost all of them died then its unbeliveable i was
there in july 08 and seen them all that was there and they were fine my dog is
now 7 months and couldn't be anymore healthier its strange you people are going
on about all this and yet i watch the news omost every day and read the paper
every day and i never once heard anything on the new or in the paper about this
place the people told me when i was there that they were getting hateful emails
and people were acusseing them of treating the puppies bad and i couldn't belive
it since they were in such good health so stop slandering these
people.
